General Terms and Conditions of Amanda Beauty GmbH and Amanda Nails GmbH (hereinafter referred to as AB/AN)

General

1. The following terms and conditions are an integral part of the contracts concluded between AB/AN and its customers.

2. By placing an order, the buyer expressly agrees to these terms and conditions.

3. These terms and conditions also apply to all subsequent transactions, without the need for this to be expressly mentioned or agreed upon again at the time of their conclusion.

4. All offers are subject to change without notice. Errors and omissions excepted.

Prices

1. All prices are ex-works and are in Swiss francs, excluding packaging/shipping costs and the applicable statutory value added tax at the time of performance.

2. Price changes due to altered market conditions are reserved.

Payment terms

1. The purchase price is due immediately upon ordering. The buyer can pay the purchase price by prepayment or PayPal.

Packaging/shipping costs

1. Packaging and shipping costs are a flat rate of CHF 9.50. Orders over CHF 290.00 are delivered free of charge. Delivery costs for furniture are not a flat rate but are calculated based on actual costs.

Purchase on account with partial payment option (POWERPAY)

MF Group / POWERPAY, as an external payment service provider, offers the payment method "purchase on account." With a single invoice, you can easily pay for your online purchase by invoice. If you do not pay within the specified timeframe, you will subsequently receive a monthly statement with an order summary in the following month.

Upon conclusion of the purchase agreement, POWERPAY assumes the resulting invoice claim and handles the corresponding payment processing. When purchasing on account, you also accept our terms and conditions.

You will receive the invoice free of charge via email. A valid email address is required.

Delivery

1. Acceptance of the order is subject to availability. The buyer also accepts partial deliveries.

2. The goods are shipped exclusively at the buyer's risk.

3. Claims for damages, rights of withdrawal or similar may also arise due to lost or damaged goods as well as time constraints.

Delays cannot be claimed as a loss by the sender.

4. Transport damage must be reported immediately to the freight forwarder and AB/AN.

5. Goods are shipped Monday to Friday (excluding public holidays) via priority mail. (Subject to availability)

Subject to change

1. The descriptions and/or illustrations of the goods merely constitute a non-binding product description and do not represent a guarantee of characteristics. AB/AN accepts no liability for possible commercially acceptable and reasonable deviations of the goods from the catalog/online shop.

2. Commercially acceptable and reasonable color variations in goods containing color additives are reserved.

Retention of title

1. The goods remain the property of AB/AN until the purchase price claim has been fully satisfied.

Right of withdrawal

1. AB/AN has the right to withdraw from the contract if the manufacturer of the ordered goods has ceased production or if force majeure occurs, provided that these circumstances arose only after the conclusion of the contract. The customer must be notified of this immediately.

Return policy

1. Goods ordered and delivered correctly can be returned within 10 days of delivery, provided they are in their original packaging, unopened, and unused. The buyer is responsible for the return shipping costs. If the goods are returned incomplete, not in their original packaging, in damaged or unsaleable original packaging, or damaged, AB/AN is entitled to claim compensation from the buyer for the diminished value. The right of return does not extend to damages for which the customer is responsible. All COVID-19 protective equipment is excluded from the right of return.

exclusion

1. AB/AN reserves the right to exclude customers who have not paid for the ordered goods within the granted payment period from further deliveries.

Data protection

1. The data necessary for processing your order will be stored and used for order fulfillment. All personal data will, of course, be treated confidentially. Personal information related to an order is transmitted using SSL encryption.

Liability

1. AB/AN excludes all liability towards the customer to the extent permitted by law.

Applicable law, place of jurisdiction

1. The legal relationship is governed by Swiss law. The exclusive place of jurisdiction for both parties is Zurich.

Severability clause

1. The possible invalidity of individual provisions of these general terms and conditions shall not affect the validity of the remaining provisions.

These General Terms and Conditions supersede all previous General Terms and Conditions, catalogs and price lists.

General terms and conditions of the Amanda Beauty GmbH Academy

Registration

All registrations are binding. Your verbal or written registration obligates you to pay the course fee. Failure to pay the course fee does not constitute cancellation.

Cancellation/Deregistration

Cancellations and/or postponements received up to 4 weeks before the start of the course will be charged a fee of 15% of the course costs.

If a cancellation and/or postponement is not made at least four weeks before the start of the course, the full course fees must be paid.

Missed or missed course days, course interruptions, or no-shows do not entitle you to a price reduction and/or a refund of the course fee and cannot be made up. Failure to attend course days does not release you from the obligation to pay the course fees. In the event of non-payment of the course fees, Amanda Beauty GmbH reserves the right to cancel your course place at short notice. The full course fees would still be payable.

certificate

Upon completion of the training, each participant receives a certificate.

Models

Participants are responsible for providing their own models for practical exercises. The absence of a model does not justify cancellation or postponement of the course.

Changes

We reserve the right to make general changes, including price changes. Amanda Beauty GmbH also reserves the right to postpone or cancel courses.

All correspondence and course materials provided are for the personal use of the course participants only.

Any reproduction, duplication, or copying, in whole or in part, is prohibited. All documents remain the intellectual property of Amanda Beauty GmbH.

Jurisdiction

The exclusive place of jurisdiction for both parties is Zurich.

validity

These General Terms and Conditions for Courses apply from 01.01.2023.

With these, all previous General Terms and Conditions of Course cease to apply.

Their validity. By registering for the course, the participant acknowledges these General Course Conditions.
